2-year-old girl’s fingertip got severed in daycare, her family demands justice

On January 25, Erin Kays from Oak Harbor, Washington, got a call no parent ever wants to get. The call came from the daycare center Erin’s daughter attended, and she was told her daughter was injured.

The mother rushed to the daycare, where she saw EMTs, frantic daycare workers, and her daughter, Leigha, with her finger wrapped in a gauze.

The staff told Erin that her daughter’s fingertip got torn off when she fell from a rocking chair. Speaking to KING 5, the mom said:

They asked her to get off the chair to sit down. She's not even two. You can't politely ask a 2-year-old to get off...and her injury didn't quite add up when she fell forward.

Erin added that the bone in her little daughter’s finger was intact and she was expected to recover well.

Erin and her husband did not believe the story of how their daughter got hurt. They filed a report with CPS and a police report.

KING 5 asked the daycare in question, Child Academy 2, for a comment. And here’s what the director said:

Any daycare has accidents. We did everything we were supposed to do, and we were not negligent.

Speaking to KIRO-TV, Erin urged other parents to choose child care providers more carefully:

I felt like people need to do a little more research into their child care, and trust your community.

The CPS investigation did not yield the results Leigha's family had hoped for. The daycare wasn’t found to be at fault. But in an update Erin shared on Facebook, she wrote there was at least some degree of justice:

I had started to give up on ever getting any justice for my daughter, until I got the best news I could have asked for: TCA WAS SHUTTING ITS DOORS! They are being forced to close because the owner of the building is refusing to renew their lease. This may not be the justice we were looking for, but I see it was a huge win.

She also added that her daughter’s finger had healed and attached a close-up picture of her hand.

How to choose a good daycare for your child

In many cases, the daycare is a place where a child spends most of their day, so it’s very important to choose a good one. Here are some tips on how to do it:

1. The daycare must have a license. Having a license is not a guarantee of a friendly atmosphere, but it confirms that the facility meets required standards.

2. Have a good look around at the place of your choice. See where children play, sleep, and eat. Pay attention to the general mood. Are daycare workers friendly and attentive? How do children feel and behave around them?

3. Don’t be afraid to ask any questions. This is a place where your child will be spending a lot of time, so ask the workers and the daycare center director any questions.

4. Talk to parents whose children go to the daycare. Are they satisfied with it? Are their children satisfied?

5. When in doubt, look for other options. Sometimes, everything looks and sounds fine, but you may get that nagging gut feeling that something is off. If something feels off about that particular daycare, go to another one.
