What is kidnapping?

First, let’s take a look at what the official resources say about kidnapping. According to the early common law, basic kidnapping is the forcible abduction or stealing of a person from their country and sending to another one.

Nowadays, generally speaking, kidnapping is the physical moving of a person against their will. According to the federal kidnapping law, confining a person to a controlled space for some unlawful purpose is also considered kidnapping. There are three degrees of kidnapping, which are based on the severity of harm caused to the victim, and whether a gun was used or not.

Types of kidnapping

We all now about the sterotypical child kidnappings by strangers and how parents can steal their children after losing legal custody rights. But there are many more different types of kidnapping.

1. Kidnapping for ransom

The stereotypical type of kidnapping, though it is the most highlighted by the media, doesn’t occur very often. Kidnapping for ransom happens when a criminal abducts a person and takes them as a hostage in order to receive money from their family, employer, or even country in exchange for the victim’s release. Nowadays, such kidnappings occur overseas by gangs to finance their criminal operations. Therefore, typically, foreign citizens who went traveling are more likely to become the victims of kidnapping for ransom.

2. Tiger kidnapping (also proxy bombings)

In this type of kidnapping, the hostage is forced to follow the kidnapper’s directions and perform their desirable actions. For example, the bank employee may be forced to open up the vault or the office worker can grant the access to the building. Another horrible example of this type of kidnapping is when the hostage is forced to plant or even detonate a bomb.

3. Express kidnapping

Express kidnapping is probably the most common type of abductions in Latin America and Africa. It happens when the kidnapper abducts the victim, takes them to an ATM and forces them to withdraw cash. Usually, this type of kidnapping doesn’t involve violence and is relatively fast.

4. Political (ideological) kidnapping

Quite possibly the most dangerous type of kidnapping is the political one, due to the amount of ideological or political power the hostage has. The abductors may want to swap the hostage for prisoners, demand a withdrawal of military forces, etc. Sometimes, the motive of such kidnapping is propaganda.

5. Virtual kidnapping

The newest form of kidnapping is a virtual abduction, and it doesn’t actually involve physical kidnapping. The criminal would call the victim’s family and demand ransom for their family member. The requested amount is relatively smaller so that the chances of a quick payment are higher. The main instrument of this type of kidnapping is threats without any proofs. The criminal’s goal is to scare the family member, so that they believe their relative is in danger.

Kidnapping punishment

A hundred years ago, any kidnapping would be punished by the death penalty. Nowadays, however, different types of kidnappings have different legal punishment. Overall, the punishments for kidnapping vary greatly by states and the degree of the crime. The most common type of kidnapping, where a parent who lost legal custody rights would abduct the child from their legal guardian, is punished by 20 or more years of life imprisonment.

The standard kidnapping punishment usually ranges from 1 to 20 years of prison. However, many states have up to life in prison penalties depending on the severity of the crime. In addition, if the abductor committed or intended to commit a sexual assault, they would be registered as a sex offender for life.

Kidnapping is a horrible crime that should be punished in all cases. But sometimes, there are other options than jail, like probation and fines. Although the latter ones are typically imposed in addition to the criminal’s prison sentence, a convicted person may be sentenced to a probation term (up to 10 years). Anyways, any person convicted of kidnapping has significantly lower chances to find a job and have a decent life.
